Algemene voorwaarden
1. Toepasselijkheid
Op 01-01-2017 is aan de naam Knijpkatershop de naam Knijpkattenshop toegevoegd. Voor beiden gelden deze Algemene Voorwaarden. Op alle aanbiedingen, bestellingen en overeenkomsten van Knijpkatershop zijn bij uitsluiting van eventuele andere algemene voorwaarden deze Algemene Verkoopvoorwaarden (hierna: Voorwaarden) van toepassing.
Het accepteren van een aanbieding dan wel het doen van een bestelling houdt in dat u de toepasselijkheid van deze Voorwaarden aanvaardt.
Van het in deze Voorwaarden bepaalde kan slechts schriftelijk worden afgeweken, in welk geval de overige bepalingen onverkort van kracht blijven.
Alle rechten en aanspraken, zoals in deze Voorwaarden en in eventuele nadere overeenkomsten ten behoeve van Knijpkatershop worden bedongen, worden evenzeer bedongen ten behoeve van door Knijpkatershop ingeschakelde tussenpersonen en andere derden.
2. Overeenkomst
Een overeenkomst komt slechts tot stand na acceptatie van uw bestelling. Knijpkatershop is gerechtigd bestellingen te weigeren dan wel bepaalde voorwaarden aan de levering te verbinden, tenzij uitdrukkelijk anders bepaald. Indien een bestelling niet wordt geaccepteerd, deelt Knijpkatershop dit mee binnen acht (8) dagen na ontvangst van de bestelling.
3. Prijzen / Aanbiedingen
Alle aanbiedingen van Knijpkatershop zijn vrijblijvend en Knijpkatershop behoudt zich uitdrukkelijk het recht voor om de prijzen te wijzigen, in het bijzonder als dat op grond van wettelijke voorschriften noodzakelijk is.
Alle prijzen zijn vermeld in euro’s. Omdat het 2e hands producten zijn, wordt er geen BTW berekend. Levering is bedoeld voor verzamelaars.
4. Retourzendingen
Retourzendingen worden niet geaccepteerd.
5. Betalingen
Bij bestellingen via Knijpkatershop kan alleen worden betaald via de bank IBAN NL29ABNA0438244583 tnv L. Feijten (BIC ABNANL2A) of Paypal, emailadres: feijten@hotmail.com
Na ontvangst van betaling wordt de order verwerkt en de goederen verstuurd. Voor het verzenden van bestellingen wordt gebruik gemaakt van de tarieven van https://www.postnl.nl/versturen/
6. Levering
De door Knijpkatershop opgegeven levertijden zijn slechts indicatief. Overschrijding van enige leveringstermijn geeft u geen recht op schadevergoeding en evenmin het recht uw bestelling te annuleren dan wel de overeenkomst te ontbinden, tenzij de overschrijding van de leveringstermijn zodanig is dat van u redelijkerwijs niet kan worden verlangd dat u de overeenkomst in stand laat. U bent in dat geval gerechtigd de bestelling te annuleren dan wel de overeenkomst te ontbinden voor zover dat noodzakelijk is.
De levering van de producten geschiedt op de plaats en het tijdstip waarop de producten gereed zijn voor verzending. Maximaal 2x per jaar zal de levertijd langer zijn dan 3 weken in verband met vakantie. Hiervan wordt geen melding gedaan via de website. Indien mogelijk zult u via door de Knijpkatershop ontvangen bestelling hierover worden bericht.
7. Eigendomsvoorbehoud
De eigendom van geleverde producten gaat pas over, indien u al hetgeen u op grond van enige overeenkomst aan Knijpkatershop verschuldigd bent, heeft voldaan. Het risico ter zake van de producten gaat reeds op het moment van de aflevering op uw over
8. Reclames en aansprakelijkheid
U heeft de verplichting om bij aflevering te onderzoeken of de producten aan de overeenkomst beantwoorden. Indien dit niet het geval is, brengt u Knijpkatershop daarvan zo spoedig mogelijk en in ieder geval binnen drie (3) dagen na de aflevering, althans nadat constatering redelijkerwijze mogelijk was, schriftelijk en gemotiveerd op de hoogte.
Indien is aangetoond dat de producten niet aan de overeenkomst beantwoorden, heeft Knijpkatershop de keuze, echter zonder verplichting daartoe, de desbetreffende producten tegen retournering daarvan te vervangen door vervangende producten dan wel de factuurwaarde daarvan te restitueren. De kosten van verzending, verpakking, etc. zijn voor rekening van de klant.
9. Elektronische communicatie en bewijs
Voor misverstaan, verminkingen, vertragingen of niet behoorlijk overkomen van gegevens en berichten ten gevolge van het gebruik van Internet of enig ander communicatiemiddel in het verkeer tussen Klant en Knijpkatershop (dan wel door Klant ingeschakelde derden), is Knijpkatershop niet aansprakelijk, tenzij en voor zover sprake mocht zijn van opzet of grove schuld aan de zijde van Knijpkatershop.
De administratie van Knijpkatershop geldt als volledig bewijs van het bestaan, de inhoud en de uitvoering van de overeenkomst met de Klant in een eventuele gerechtelijke procedure, tot op tegenbewijs door de partij, die zich beroept op het feit dat het bewijs niet betrouwbaar is.
10. Overmacht
Onverminderd de overige aan haar toekomende rechten, heeft Knijpkatershop in geval van overmacht het recht om, naar eigen keuze, de uitvoering van uw bestelling op te schorten, dan wel de overeenkomst zonder rechterlijke tussenkomst te ontbinden, zulks door u dit schriftelijk mee te delen en zulks zonder dat Knijpkatershop gehouden is tot enige schadevergoeding, tenzij dit in de gegeven omstandigheden naar maatstaven van redelijkheid en billijkheid onaanvaardbaar zou zijn.
Onder overmacht wordt verstaan iedere tekortkoming welke niet aan Knijpkatershop kan worden toegerekend, omdat zij niet te wijten is aan haar schuld en noch krachtens de wet, rechtshandeling of in het verkeer geldende opvattingen voor haar rekening komt.
11. Toepasselijk recht en bevoegde rechter
Op alle rechten, verplichtingen, aanbiedingen, bestellingen en overeenkomsten waarop deze Voorwaarden van toepassing zijn, alsmede op deze Voorwaarden, is uitsluitend Nederlands recht van toepassing.
Alle geschillen tussen partijen zullen bij uitsluiting worden voorgelegd aan de daartoe bevoegde rechter in Nederland.
Met het plaatsen van een bestelling gaat u tevens akkoord met deze voorwaarden.
